With reference to the current report no. 25/2017 concerning the choice of the most favourable offer under the tender announced by Tauron Dystrybucja S.A. (hereinafter referred to as ‘Ordering Party’), the management of Apator SA informs that 24th August 2017, it concluded the contract with the Ordering Party. The subject matter of the contract is the delivery of singe- and three-phase energy meters, with the value 18,1 mln in 2018, with the option of deliveries available in 2019 of the value of 5,4 mln PLN. Due to the above, the joint value of the contract with the right to option amounts to 23,5 mln PLN.

The conditions of the contract contain the stipulations concerning liquidated damages, with the entire liability on the part of Apator SA related to the said damages is limited to the amount equal to 100% of net revenue. Still, the Ordering Party may issue a claim against Apator SA for supplemental damages, as provided for in the Civil Code.

Concluding the contract was preceded by appeal proceedings, the result of which was to uphold the choice of Apator SA as the most favourable offer as valid.
