With reference to current raport no. 7/2023, the Management Board of Apator SA announces about made annex to Multipurpose Agreement between PKO BP SA and companies of Apator Groupe: Apator SA, Apator Powogaz SA, Apator Metrix SA (hereinafter referred to as ”Companies”).

The subject of the annex is the granting of a multipurpose credit limit in the total amount of PLN 80 million for the current financing of the Companies' operations. The credit limit could be available for use in the form of revolving loans, bank guarantees and letters of credit. The loan will mature on 31 May 2028.

The interest rate on the limit is based on WIBOR/EURIBOR 1M, SOFR O/N, SONIA O/N, plus the bank's margin. The collaterals of the contract are:

• total contractual mortgage on real estates of Apator Powogaz SA and Apator Metrix SA,
• registered pledge on movable assets of Apator SA, Apator Powogaz SA and Apator Metrix SA,
• assignment of rights from the insurance policy of the above collaterals,
• statement on submission to execution under art. 777 § 1 item 5 of the Act of 17th November 1964 Code of Civil Proceedings (Journal of Laws of 2021 item 1805 with later amendments) in each of the companies.

Liabilities under the granted limit shall be borne by the Companies jointly and severally, up to the maximum amount of PLN 80 mln.
