The Managing Board of the Issuer informs that on 5th June 2018 settlement was concluded between Tauron Dystrybucja S.A. and Consortium with the participation of a dependent company  – Apator Rector sp. z o.o. Ltd Co.; the leader of the Consortium is Comarch S.A.

In accordance with the concluded settlement, Tauron Dystrybucja S.A. decreased its demand to pay contractual penalties arising from the delay in the performance of the contract to perform and implement the System of Managing the Grid Assets (System Zarządzania Majątkiem Sieciowym) from the amount of 30.2 million PLN to the amount of 11.1 million PLN, renouncing, at the same time, further demanding of the accrued contractual penalties.  

The penalties shall be settled by Apator Rector sp. z o.o. Ltd. Co, whereas, pursuant to the provisions of the concluded settlement they shall be subject to settlement by contractual setting off from the claim  to pay for the additional work identified by Tauron Dystrybucja S.A. of total value of about 24 million PLN, the performance of which shall take place in years  2018-2022.

The Issuer, by the current report No. 38/2017 of 24th October 2017 informed  on receiving the call to pay  the contractual penalty.

The Parties undertook the measures for the above mentioned settlement to be approved by appropriate Court.
