The Executive Board of Apator SA announces that on the 30th May 2012 Apator Powogaz SA received the contract concluded by correspondence on the 28th May 2012, the contract of registered pledge on inventories of the Company. The contract was signed between Bank Zachodni WBK SA with headquarters in Wrocław and subsidiary –Apator Powogaz SA with headquarters in Poznań. According to the contract the highest amount of hedging is 22,5 m PLN. The contract was signed due to the contract of the loan up to the amount of 15 m PLN concluded on the 5th April 2012 by Apator Powogaz SA and Bank Zachodni WBK SA.The amount will be used to finance current activity and repayment of the loan on current account (change of the bank rendering services for the Company). On the 30th May 2012 Apator Powogaz SA filed a petition to the District Court in Poznań Nowe Miasto and Wilda VII Economy Department to register it on the list of pledgers. There are no connections between the issuer and persons managing or supervising the issuer and the entity and its managing persons towards which the registered pledge was established. The criterion being the basis to consider as significant assets is the establishment of pledge on assets exceeding the value of 1m Eur calculated into PLN according to average exchange rate announced by the National Bank of Poland binding on the day of conclusion of the contract. Legal base: § 5 para 1 point 1 of the Regulation of Minister of Finance regarding current and regular information being transferred by the issuers of securities and conditions to be considered as equivalent information required by law of the country not being the member of the EU.
