Further to current report no.10/2013 dated 26th March 2013 concerning the tender of the value 24,8 m PLN won by subsidiary - Apator Control sp. z o. o. and current report no.11/2013 dated 25th April 2013 concerning the guarantee to be granted by Apator SA due to the performance of the contract by Apator Control sp. z o .o., the Executive Board of Apator SA announces that Apator Control sp. z o. o. concluded with ArcelorMittal Poland SA the contract of the supply of the control equipment and accessories for industrial automatics in “Electrical revamping of Long Rail project”. The value of the contract is 24,8 m PLN. The contract will be performed till 28th February 2014. The contracts meets the criterion of important contract due to its value exceeds 10% of equity of the issuer that is Apator SA.

The Executive Board of Apator SA announces that the conditions of the above contract do not differ from the typical conditions for such type transactions and it was not concluded with restriction  to the term and condition.

ArcelorMittal Poland SA has the right to liquidated damages for the failure of the fulfilment of tasks resulting of the work schedule: 1% of contract price for the entire week of delay to the maximum amount of 10% of contract price.
Legal base for the report: § 5 article 1 point 3 of the Regulation of Minister of Finance regarding current and regular information being transferred by the issuers of securities and conditions of the information to be considered as equivalent one required by law of the country not being the member of the EU.
